Gender Harassment Committee

THE OBJECTIVES OF THE COMMITTEE ARE

  • To prevent discrimination and sexual harassment against women, by promoting gender amity among students and employees;
  • To make recommendations to the Presiding officer / and or Dean for changes / elaborations – – in the Rules for students/ Employees – to make them gender just and to lay down procedures for the prohibition, resolution, settlement and prosecution of acts of discrimination and sexual harassment against women, by the students and the employees;
  • To deal with cases of discrimination and sexual harassment against women, in a time bound manner, aiming at ensuring support services to the victimized and termination of the harassment;
  • To recommend appropriate punitive action against the guilty party to the Presiding officer / and or Dean.

ACTS OF SEXUAL HARASSMENT

It is defined that according to the Supreme Court guideline Sexual harassment can be defined as “unwelcome” sexually determined behaviour (whether directly or by implication) as:

  • Physical contact and advances;
  • Demand or request for sexual favours;
  • Sexually coloured remarks;
  • Showing pornography; and
  • Other unwelcome physical, verbal or non-verbal conduct of a sexual nature.
  • Eve-teasing,
  • Unsavoury remarks,
  • Jokes causing, or likely to cause awkwardness or embarrassment,
  • Innuendos and taunts,
  • Gender based insults or sexist remarks,
  • Unwelcome sexual overtone in any manner such as over telephone (obnoxious telephone calls) and the like,
  • Touching or brushing against any part of the body and the like .
  • Displaying pornographic or other offensive or derogatory pictures, cartoons, pamphlets or sayings,
  • Forcible physical touch or molestation; and
  • Physical confinement against one’s will and any other act likely to violate one’s privacy.

PROTOCOL FOR APPROACHING THE COMMITTEE

The Committee shall deal with issues relating to sexual harassment at the Gouri Devi Institute of Medical Sciences & Hospital campuses. It is applicable to all students,  Non teaching staff , Nursing  staffs and faculties . A complaint of discrimination or sexual harassment may be lodged by the victim or a third party. An online/written complaint may be addressed to the Presiding officer of the Committee. If the complaint is made to the Dean, Medical Superintendent or any of the Committee members, they may forward it to the Presiding officer of the Committee against Sexual Harassment. The committee under the leadership of Presiding officer will do enquiry by issuing, internal enquiry order to the concerned persons and prepare the report with the recommendations. The enquiry report and action taken report will be sent to the concerned authority.

In case of Academics (faculties)/ administrative (teaching/non teaching ) / technical / nursing / management staffs disciplinary action for the persons found guilty   is as follows :-

  • Warning
  • Written apology
  • Bond of good behaviour
  • Gender sensitization
  • Counselling
  • Adverse remarks in the Confidential Report
  • Debarring from supervisory duties
  • Denial of membership of statutory bodies
  • Denial of re-employment
  • Stopping of increments/promotion
  • Reverting, demotion
  • Transfer
  • Dismissal
  • Withdrawal of residential facilities and prohibition from entry on the campus etc.
  • Any other relevant mechanism.

In case of students disciplinary action can be as follows :-

  • Warning
  • Written apology
  • Bond of good behaviour
  • Gender sensitization
  • Counselling
  • Debarring entry into a hostel/ campus
  • Withholding results
  • Debarring from exams
  • Debarring from contesting elections
  • Debarring from holding posts
  • Expulsion
  • Denial of admission
  • Declaring the harasser as “persona non grata” for a stipulated period of time
  • Any other relevant mechanism.

 

NOTE: The reasons for the action have to be provided in writing. Action will be taken against person(s) who try to pressurize the complainant in any way
